2. Purpose and acceptance

This legal notice governs access to and use of www.carbonica.es (the "Website"). Anyone who accesses the Website becomes a user (the "User") and accepts this legal notice as published at the time of access. Access is free of charge, apart from the cost of the User's own internet connection.

3. Terms of use

The User agrees to use the Website lawfully, in good faith and in line with this legal notice. In particular, the User must not:

  • use it for unlawful purposes or in a way that harms the rights of Carbónica or third parties;
  • introduce viruses or other harmful code, or attempt to gain unauthorised access to its systems;
  • extract or reuse its content for commercial purposes without authorisation.

Where the Website asks the User for information, for example through a contact form, the User confirms that it is true, complete and current, and will tell Carbónica of any change.

Carbónica may suspend access for anyone who breaches these terms, without any right to compensation.

4. Intellectual and industrial property

All content on the Website, including text, photographs, graphics, logos, trademarks, design and source code, belongs to Carbónica or to third parties who have authorised its use. Manufacturer and supplier trademarks shown on the Website belong to their respective owners.

Reproduction, distribution, public communication or transformation of this content, in whole or in part, requires Carbónica's prior written consent. Viewing and printing for personal, private use is permitted.

5. Product and safety information

Technical information on gases, cylinders and equipment published on the Website is general and for information only. It does not replace safety data sheets, manufacturers' manuals or the rules on handling, storing and transporting gases under pressure. Before using any product, the User must read the documentation supplied with it.

Nothing on the Website is a binding offer. Supply terms, prices and availability are those stated in the relevant quotation or contract. Where the Website shows prices, it will state whether they include applicable taxes and, where relevant, delivery charges.

6. Liability

Carbónica takes care to keep the information on the Website accurate and up to date but does not guarantee that it is free of errors or that the Website will be available without interruption. To the extent permitted by law, Carbónica is not liable for loss caused by technical interruptions, viruses or other harmful elements not attributable to it, or by use of the Website contrary to this legal notice.

7. Links

The Website may contain links to third-party sites. Carbónica has no control over those sites and is not responsible for their content. If Carbónica becomes aware that a link leads to unlawful content, it will remove the link promptly, in accordance with Article 17 LSSI-CE.

Anyone wishing to link to the Website must link to its home page, without reproducing its content or suggesting a connection with, or endorsement by, Carbónica that does not exist.

8. Data protection and cookies

Personal data is processed in accordance with the Privacy Policy, under Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD). Cookies are used in accordance with the Cookie Policy, under Article 22.2 LSSI-CE. Both are available in the Website footer.

9. Changes, language and severability

Carbónica may amend this legal notice at any time. The version that applies is the one published on the Website at the time of access. This legal notice is drafted in Spanish; if there is any discrepancy with a translation, the Spanish version prevails.

If any provision of this legal notice is held void or unenforceable, the remaining provisions stay in full force.

10. Governing law and jurisdiction

This legal notice is governed by Spanish law. The parties submit to the courts of Eivissa (Ibiza) for any dispute, unless the User is a consumer, in which case the courts of the User's place of residence, or those designated by procedural and consumer protection law, have jurisdiction.
